Please join us for an engaging evening of discussion and insight with The Hon Justice Kristina Stern, Justice of the Supreme Court of NSW and Judge of the Court of Appeal, who will speak on Arbitration and the High Court.
The address will look at particular aspects of the decisions of the High Court in Rinehart v Hancock Prospecting Pty Ltd (2019) 267 CLR 514, CBI Constructors Pty Ltd v Chevron [2024] HCA 28, Kingdom of Spain v Infrastructure Services Luxembourg S.à.r.l [2023] HCA 11; 275 CLR 292 and the upcoming appeal in Republic of India v CCDM Holdings LLC [2025] FCAFC 2. Whilst these cases cover a range of different issues, they highlight matters of significance to both the construction of arbitration agreements and the conduct of arbitration proceedings and perhaps can offer insights into the High Court’s approach more generally to arbitral proceedings.
