The Hon Justice Clyde Croft AM was, from 2009 to 2019, a Judge of the Supreme Court of Victoria and the Judge in charge of the Arbitration List in the Commercial Court of the Supreme Court. Sitting in the Arbitration List, Justice Croft delivered many important and influential judgments developing arbitral jurisprudence on the UNCITRAL (United Nations Commission on International Trade Law) Model Law as it now applies in Australia.

He was appointed a Reserve Judge of the Supreme Court in 2021 and, since 2023, has again been sitting full time as a Judge in the Commercial Court.

Justice Croft was a Professor in the Monash University Law Faculty and formerly Convenor of the Monash Law Commercial Disputes Group (2020 to 2022). He was also an Adjunct Professor of Practice in the Law Faculty (2023 to 2025).

Prior to his Court appointment in 2009, Justice Croft commanded a very extensive practice at the Bar in property and commercial law, and as an arbitrator and mediator in property, construction and commercial disputes nationally and internationally. He was appointed Senior Counsel by Letters Patent in 2000 and holds the degrees of BEc, LLB and LLM from Monash University and a PhD from the University of Cambridge.

Justice Croft chaired the Expert Advisory Committee of the UNCITRAL National Coordination Committee of Australia (UNCCA) (2018–2023), which supports UNCITRAL Working Group II (Arbitration and Conciliation). He represented the Asia Pacific Regional Arbitration Group (APRAG) at UNCITRAL Working Group II sessions from 2005 to 2010, revising the UNCITRAL Model Law and the UNCITRAL Arbitration Rules. On the basis of this UNCITRAL work he co-authored A Guide to the UNCITRAL Arbitration Rules (Cambridge University Press, 2013).

Justice Croft also chaired the recent Funds in Court Review in the Supreme Court of Victoria and has, over many years, served on committees of organisations providing disability accommodation services, including as President of the Geelong Regional Residential Association for the Intellectually Disabled (GRID) and as President of GRID’s state-wide peak organisation, VICRAID.

Justice Croft is a co-author of two editions of Australian Commercial Arbitration (LexisNexis, 2015 and 2021; and digital) and, more recently, International and Australian Commercial Arbitration (LexisNexis, 2021). He is also the author or co-author of many leading national texts in the fields of commercial and retail leases, mortgages and securities, and equity. He has also been an independent international and national commercial arbitrator and mediator.

He is a Life Fellow of the Australian Centre for International Commercial Arbitration (ACICA), a Life Fellow of the Resolution Institute (incorporating the Institute of Arbitrators and Mediators Australia), a Judicial Fellow of the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ), and a Fellow of the Chartered Institute of Arbitrators and the Australian Academy of Law.

Justice Croft was appointed an Academic Bencher of the Inner Temple, London, in 2025 and is an Academic Fellow of Falcon Chambers, London.

Justice Croft was appointed a Member of the Order of Australia (AM) in the Australia Day Honours 2019 “For significant service to the law, and to the judiciary, particularly through commercial arbitration.“
